Preamble

This document sets forth the comprehensive terms and conditions governing the application and registration for courses offered by IMMAST. By submitting an application, making payment of course fees, or commencing participation in any course, the applicant/participant unequivocally acknowledges, understands, and agrees to be legally bound by all provisions stipulated herein. These terms constitute a legally binding agreement between IMMAST and the applicant/participant.

1. Course Registration and Confirmation

  • 1.1. No Guarantee of Admission: The mere submission of course fees does not, in itself, constitute an offer of admission or a guarantee of registration to any course offered by IMMAST.
  • 1.2. Confirmation Process: Confirmation of an applicant's registration is strictly contingent upon, and subject to:
    • a. The successful verification of all eligibility criteria as stipulated by IMMAST.
    • b. The complete, accurate, and timely submission of all requisite documentation.
    • c. The complete reconciliation of all applicable course fees.
    • d. IMMAST's internal admission and approval processes.
  • 1.3. Official Notification: Official confirmation of registration shall be communicated solely via electronic mail to the primary email address provided by the applicant during the application process. Applicants are responsible for ensuring the accuracy of their contact information and for checking their email regularly.

2. Incomplete, Deficient, or False Submissions

  • 2.1. Incomplete/Deficient Documentation: IMMAST reserves the unequivocal right to cancel, reject, or provisionally suspend the application or registration of any applicant/participant whose submitted documentation is, in the sole and absolute discretion of IMMAST, deemed incomplete, insufficient, illegible, inaccurate, or otherwise deficient. Such action may be taken without the necessity of providing specific reasons or prior notice to the applicant/participant.
  • 2.2. False or Misleading Information: Any submission of information by an applicant/participant that is found to be false, fraudulent, inaccurate, or misleading in any material respect, whether intentional or unintentional, at any stage of the application, registration, or during the course tenure, shall result in:
    • a. The immediate and irreversible cancellation of the applicant's candidature and/or the participant's registration.
    • b. The forfeiture of all course fees paid to IMMAST.
    • c. IMMAST reserving its right to initiate any and all appropriate legal remedies and actions available under applicable Indian law against such applicant/participant, including but not limited to, reporting to relevant professional or regulatory bodies.

3. Right to Refuse or Terminate Registration

  • 3.1. IMMAST reserves the absolute right, at its sole and unfettered discretion, to refuse admission or terminate the registration of any applicant or participant at any point, including after initial registration and payment of fees, without the obligation to provide any specific reasons for such refusal or termination.
  • 3.2. In case of a participant not intending / unable to participate in an educational programme after registering for it, the participant must send written communication / email communication to IMMAST, expressing the same. Only requests of such nature received 15 working days prior to the starting date / first day of the intended course registered for, will be considered for an offer of registration roll over to other dates / courses in same specialty or pro-rata refund of the registration fee paid. This consideration does not guarantee roll over of the registration or refund of fee paid. IMMAST reserves the absolute right, at its sole and unfettered discretion, to refuse roll over and refund, without the obligation to provide any specific reasons for such refusal.
  • 3.3. Consequences of Termination: In the event of such refusal or termination by IMMAST, IMMAST's liability, if any, shall be strictly limited to a pro-rata refund of course fees for services not yet rendered, calculated at IMMAST's sole discretion. This limited refund explicitly excludes any administrative charges, non-refundable deposits, costs associated with course materials already provided, or any other costs or expenses incurred by the applicant/participant.

4. Limitation of Liability

IMMAST shall not be held responsible or liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary loss, damage, expense, or injury whatsoever, howsoever arising from, or in connection with, but not limited to:

  • a. The denial, cancellation, or rejection of registration or admission to any course.
  • b. The applicant's/participant's failure to meet eligibility criteria or to submit complete, accurate, or timely documentation.
  • c. Any actions taken by IMMAST pursuant to the terms of this Policy.
  • d. Any technical issues, errors, delays, or interruptions in the application/registration process or online platforms beyond IMMAST's reasonable control.
  • e. Any personal injury, infection, allergic reaction, adverse health outcome, exposure to biological agents, or other physical, psychological, or medical harm sustained by the participant during their presence in or use of IMMAST facilities. This includes, without limitation, laboratories, operating rooms, simulation centres, and areas involving the handling of cadavers, animal tissues, biological specimens, hazardous materials, or medical equipment, irrespective of whether such harm is directly or indirectly related to course activities, equipment usage, or instructional methods.

5. Damage to Equipment and Property

Participants are obligated to exercise the highest degree of care and caution when handling and utilizing all IMMAST equipment, instruments, simulators, models, cadavers, animal tissues, and any other property (hereinafter collectively referred to as "IMMAST Property").

Any damage, loss, or destruction to IMMAST Property caused by a participant, whether arising from negligence, misuse, improper handling, or willful act, shall be subject to full recovery of costs from the participant responsible. IMMAST reserves the exclusive right to assess the extent of damage and the corresponding cost of repair or replacement, and the participant shall be billed accordingly. Failure to compensate for such damage may result in immediate suspension from the course and/or withholding of course completion certificates or any other credentials, without prejudice to IMMAST's other legal rights to recover damages.

6. Certification and Issuance of Certificates

  • 6.1. Issuance of any course completion certificate, diploma, or other credential by IMMAST is strictly contingent upon the participant's full compliance with all course requirements, academic standards, and these terms and conditions.
  • 6.2. IMMAST reserves the absolute right to refuse, withhold, or revoke any certificate, diploma, or credential from a participant in the event of, but not limited to, the following circumstances:
    • a. Submission of incorrect, fraudulent, or misleading information at any stage of the application, registration, or during the course tenure.
    • b. Deficient attendance, as determined solely by IMMAST based on its records.
    • c. Non-completion or unsatisfactory completion of mandated assessments, examinations, projects, assignments, surveys, or any other required course components.
    • d. Failure to achieve the minimum required academic or practical performance standards as specified for the course.
    • e. Violation of IMMAST's code of conduct, disciplinary policies, or any other terms stipulated in this Policy.
    • f. Non-payment of any outstanding dues, fines, or charges owed to IMMAST by the participant.
    • g. Any other material breach of these Course Registration Policy & Terms by the participant.

7. Policy Acceptance

By submitting an application, making payment of course fees, or commencing participation in any course, the applicant/participant unequivocally acknowledges, understands, and expressly agrees to be bound by all terms and conditions set forth in this IMMAST Course Registration Policy & Terms. This agreement shall be governed by and construed in accordance with the laws of India, and the courts in Mumbai shall have exclusive jurisdiction over any disputes arising hereunder
